EXECUTION
ORDER-21


RULE NO.1- Mode of paying money under decree
1)(a) judgement debtor directly or by deposit or by postol order ya phir through a bank bhi court ko send kar skta hai.


(b)out of court-by postal order,bank or any other mode(evidenced in written)


(c) otherwise (as the court which made the decree,directs.)


2)agar payment clause(a)or(c) k according dega to judgement debtor dwara decree holder ko notice diya jayega-either through court or directly to him by registered post, acknowledgement due.


3)clause(a)&(b)comtain particilars:-
a)no.of the original suit
b)name of the parties
c)how to money remitted is to be adjusted-PRINCIPLE, INTEREST OR COSTS
d)no. of execution case
e)name & address of the payer


4)sub-rule 1 main (a) or (b) k according payment krne pe notice(sub-rule 2) k baad se interest nhi lgega.


PROVISO:-AGAR D-HOLDER KHUD MNA KRTA HAI THROUGH POSTAL ORDER OR THROUGH A BANK PAYMENT LENE SE TO BHI USSI DIN SE INTEREST LGNA BAND HO JAYEGA.

RULE NO.2

1)agar out of court parties koi adjustment kr leti hai partly or whole payment ki to d-holder court ko us adjustment k bare me btayega and court shall record the same accordingly.


2) judgement debtor also may inform to court about such payment or adjustment &apply to court to issue a notice to d-holder to show cause.


2A)no payment or adjustment shall be recorded,unless:a)as per rule.1; b)proved by documentary evidence; c)jab d-holder admit krle.


3)agar d-holder payment or adjustment ko certified na lre or recorded na kraye to court execution decree jari rkhega.
